These Terms of Service ("Terms") apply when you visit our website at siftr.ai or when you chat with a Siftr-powered assistant as an end user. The website and assistant platform are operated by Mulholland Capital Partners LLC, a California limited liability company, doing business as Siftr.AI ("Siftr," "we," "us," or "our").
If you are a business or individual using Siftr to configure and operate an assistant, your use is governed by our separate Customer Terms of Service, not by these Terms.
By using our website or chatting with a Siftr-powered assistant, you agree to these Terms. If you do not agree, please do not use the website or the assistant.
1. What Siftr is
Siftr powers AI assistants for businesses and individuals ("Customers"). When you message a Customer's assistant, it helps you search that Customer's content and recommendations and, where helpful, find products from Customer-approved retailers. You do not need a Siftr account to use a Siftr-powered assistant, though you may need an account or service on the channel you use to reach it, such as an Instagram or Facebook account or a mobile phone number.
2. The assistant is automated
You are chatting with an AI assistant, not a person. The assistant generates answers automatically, using the Customer's content and other information. Because the assistant is automated, its responses are generated dynamically and may be unexpected, may vary between conversations, and will not always be consistent. Its responses, including any product information, prices, availability, and scores, may be inaccurate, incomplete, or out of date. Treat them as helpful suggestions, not professional advice, and double-check anything important before you act on it. We do not guarantee any particular result or outcome.
3. Product links and purchases
The assistant may share links to products, stores, or other websites, including affiliate links that may earn the Customer a small commission at no extra cost to you. Any purchase you make is solely between you and the relevant store. We do not sell those products, do not guarantee them, and are not responsible for any purchase, transaction, or dispute. Please review the store's own terms before buying, and direct any issue with a purchase to that store. The information shown at the point of purchase on the relevant store is always the definitive product information.
4. Your choices and your data
You are in control of your conversation:
- Say STOP at any time to end a conversation. On SMS, replying STOP stops the messages.
- Say Delete my data at any time to have your conversation history erased.
- Say HELP at any time for a link to our help page at siftr.ai/help-users.
How we handle the information you share when you chat is described in our Privacy Policy. When you chat with a Customer's assistant, that Customer decides how your information is used, and Siftr handles it on the Customer's behalf.
5. Acceptable use
When using the website or an assistant, you agree not to:
- use them for any unlawful purpose or to encourage unlawful acts;
- harass, abuse, threaten, or harm any person;
- submit content that infringes the rights of others or that is false or misleading in a harmful way;
- upload or transmit malware or harmful code;
- attempt to disrupt, overload, scrape, or gain unauthorized access to the website, the assistant, or our systems;
- use the assistant or its responses to develop or train a competing product or AI model, or to present AI-generated responses as human-created; or
- misuse the service in a way that interferes with others' use of it.
We may suspend or block access to anyone who misuses the website or an assistant.
6. Intellectual property
The website and the Siftr platform, including our software, text, graphics, and logos, are owned by Siftr or our licensors and are protected by intellectual property laws. The content and recommendations a Customer provides to inform their assistant remain the property of that Customer or its licensors. We grant you permission to use the website and assistant for your own personal, non-commercial use only. You receive no ownership or other rights in the Siftr platform, a Customer's content, or the assistant's responses.
7. No warranty
The website and the assistant are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that they will be uninterrupted, secure, error-free, or that any output or information will be accurate or reliable.
8. Limitation of liability
To the maximum extent permitted by law, Siftr and its owners, members, managers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of, or inability to use, the website or an assistant, including any reliance on assistant output or any purchase you make through a link. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
9. Changes to these Terms
We may update these Terms from time to time. The current version is always posted here with an updated "Last updated" date. Your continued use after a change takes effect means you accept the revised Terms.
10. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and any dispute will be subject to the courts located in Los Angeles County, California.
